“The Supreme Court will decide whether Congress has the power to withdraw the public domain status of so many works of art and, in the process, change the contours of the copyright system that has given rise to Hollywood and every other American cultural industry. Restoring the copyright of works in the public domain is a different issue than the perpetual elongation of copyright terms. By removing works from the public domain, Congress has destabilized it.”
